Terms of Service

1. Acceptance of these terms

These Terms of Service ("Terms") are an agreement between Furdentify LLC, a California limited liability company ("Furdentify," "we," "us") and the organization that signs up for the service (the "Organization," "you"). By creating an account, inviting users, or otherwise using Furdentify, you agree to these Terms on behalf of your Organization and represent that you have authority to do so. If you do not agree, do not use the service.

2. The service

Furdentify is web-based management software for animal shelters and rescues. It includes, among other features, animal records, medical tracking, foster management, adoption and foster application forms, donation tracking and acknowledgment letters, public adoptable pet pages, and team accounts with role-based access.

Furdentify is currently offered as an early-access (beta) product. Features may be added, changed, or removed as the product develops. We will make reasonable efforts to communicate changes that materially affect your use of the service.

3. Accounts and access

Your Organization's administrator controls who can access your account. Administrators may invite team members by email and assign roles (such as admin, manager, staff, or read-only volunteer). You are responsible for the people you invite, for assigning appropriate roles, and for deactivating accounts when someone leaves your Organization.

Each user is responsible for keeping their login credentials confidential. Notify us promptly at [email protected] if you believe an account has been compromised.

4. Your data

Your records belong to you. The animal records, medical histories, contacts, form submissions, photos, and other content your Organization enters into Furdentify ("Organization Data") remain yours. We claim no ownership of Organization Data, and we use it only to provide and support the service.

Each Organization's data is stored in its own separate database, isolated from other customers. We maintain routine backups. You can export your data (including CSV and file exports) from within the service at any time.

If your subscription ends, we will make your data available for export for a reasonable period (at least 30 days) before deletion, unless a longer period is required by law.

5. Personal information you collect from others

Furdentify lets you collect and store personal information about third parties, such as adopters, applicants, fosters, donors, and previous owners. For that information, your Organization is the data controller and Furdentify acts as a service provider (processor) on your instructions. You are responsible for:

  • having a lawful basis to collect and store that information;
  • the accuracy of what you enter;
  • responding to requests from individuals about their information (we will assist where reasonably needed); and
  • complying with privacy laws that apply to your Organization.

6. Public content you publish

Furdentify can publish content publicly on your behalf, including adoptable pet pages, embeddable listings on your own website, and public application forms. You control which animals and fields are public. You are responsible for the content you choose to publish, including photos and descriptions, and for ensuring it does not infringe anyone's rights.

7. Acceptable use

You agree not to:

  • use the service for any unlawful purpose or in violation of animal welfare laws applicable to you;
  • upload malicious code or content, or attempt to probe, breach, or overload the service;
  • access another organization's data or attempt to bypass access controls;
  • resell or provide the service to third parties outside your Organization; or
  • use the service to send spam or unsolicited communications.

8. Subscriptions, pricing, and plan limits

Paid plans are priced by tier, based on the number of animals in your Organization's care. Current pricing is listed on our pricing page. Plans are billed monthly or annually.

New subscriptions include the first 30 days free. Billing begins when the free period ends, and your first charge covers the billing period ahead. If you cancel during the free period, you owe nothing.

Plan tiers include a soft limit on animals in care. If your Organization exceeds its tier's limit, the service will continue to work; we will contact you about moving to a plan that fits. We will never lock you out of your records or block you from adding an animal in need because of a plan limit without attempting to contact you first.

We may change pricing with reasonable advance notice. Price changes take effect at your next renewal, not mid-term.

9. Cancellation and termination

You may cancel at any time; your plan remains active through the end of the period you have paid for. Unless required by law, fees already paid are non-refundable, though we may issue refunds at our discretion (for example, for extended outages).

We may suspend or terminate access for material breach of these Terms, including non-payment or violation of the acceptable use rules, after giving you notice and a reasonable opportunity to cure where practical. Section 4 (data export before deletion) applies regardless of the reason the subscription ends.

10. Support and support access

We provide support by email. Our support staff cannot access your Organization's data unless an administrator explicitly grants time-limited support access from within the service. Support access is read-only by default, is logged, expires automatically, and can be revoked by you at any time.

11. Availability and backups

We work to keep the service available and reliable, but we do not guarantee uninterrupted access, particularly during the beta period. We maintain automated backups of Organization Data. You are encouraged to use the built-in export tools to keep your own copies of critical records.

12. Donation acknowledgments and other generated documents

Furdentify can generate documents from your data, including donation acknowledgment letters for tax purposes. These documents are produced from the information and settings your Organization provides (such as your tax status and EIN). Furdentify does not provide legal, tax, or accounting advice, and you are responsible for confirming that generated documents meet the requirements that apply to your Organization.

13. Third-party services

The service relies on third-party providers for functions such as transactional email delivery, bot protection on public forms, payment processing, and encrypted offsite backups. We choose providers with appropriate security practices; their processing of data is governed by their own terms and our agreements with them.

14. Intellectual property

Furdentify, including its software, design, and branding, is owned by us and protected by applicable intellectual property laws. We grant your Organization a limited, non-exclusive, non-transferable right to use the service during your subscription. Feedback you send us may be used to improve the product without obligation to you.

15. Disclaimers

The service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be error-free or uninterrupted.

16. Limitation of liability

To the fullest extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data (except for each party's confidentiality, data protection, or indemnification obligations). Our total liability arising out of the service is limited to the amounts you paid us in the twelve months before the event giving rise to the claim.

17. Indemnification

You will defend and indemnify Furdentify against third-party claims arising from Organization Data you enter or publish, or from your use of the service in violation of these Terms or applicable law.

18. Changes to these terms

We may update these Terms from time to time. If a change is material, we will notify administrators by email or in the service at least 14 days before it takes effect. Continued use after the effective date constitutes acceptance.

19. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. The parties will first attempt to resolve disputes informally by contacting us; unresolved disputes will be handled in the state or federal courts located in San Diego County, California.
